This policy explains what personal data Stuttguard Limited collects through this website and when you contact us, why we use it, and the rights you have under the Kenya Data Protection Act, 2019 and, where it applies to you, the EU General Data Protection Regulation (GDPR).
Who we are
The data controller is Stuttguard Limited, a company registered in Kenya (registration number PVT-PJUVPM3), Hughes Building, 3rd Floor, Unit 7, Muindi Bingu Street, P.O. Box 45984-00100, Nairobi, Kenya. Email: ceo@stuttguardlimited.com.
What we collect
- What you send us. The contact form on this website does not send anything to our servers. It prepares a message (your name, company, country, topic and message) that you choose to send to us on WhatsApp or by email. When you send it, we receive those details and your phone number or email address.
- Business correspondence. Names, job titles, company details, phone numbers and email addresses of the people we deal with as customers, suppliers and partners, and the content of quotations, orders and contracts.
- Technical data. Our web host keeps standard server logs (IP address, browser type, the page requested and the time) to run and secure the website.
- Analytics, only with your consent. If we switch on Google Analytics and you accept analytics cookies, Google Analytics records pages viewed, approximate location, device and browser type. We do not use advertising or remarketing features.
We do not collect special categories of personal data through this website, and the website is not intended for children.
Why we use it and our legal basis
- To answer your enquiry, prepare quotations and deliver what you order: taking steps at your request before entering into a contract, and performing that contract.
- To meet legal duties, such as tax, licensing (EPRA, NCA, mining) and anti-money-laundering records: legal obligation.
- To keep the website secure and working: our legitimate interests.
- To measure website use with analytics cookies: your consent, which you can withdraw at any time.
Cookies
This website does not set any cookies unless you accept analytics cookies in the cookie banner. The banner only appears when analytics is switched on. You can change your choice at any time with the Cookie settings link at the bottom of each page, or by clearing this site's data in your browser.
If you accept, Google Analytics sets cookies whose names start with _ga. They last up to 2 years. If you reject, no analytics script is loaded.
Who we share it with
- Service providers that run our communications and website: WhatsApp (Meta), Google (email and, with consent, analytics), and our web host in Kenya.
- Authorities and advisers where the law requires it, such as the Kenya Revenue Authority, EPRA, the National Construction Authority or the Ministry of Mining, and our auditors and lawyers.
- Logistics and inspection partners such as transporters, clearing agents and assay laboratories, only as needed to deliver an order.
We do not sell personal data.
International transfers
Some providers, including WhatsApp and Google, store data outside Kenya. We rely on their contractual and security safeguards, as the Data Protection Act, 2019 and the GDPR require.
How long we keep it
We keep enquiries that do not lead to business for up to 2 years. We keep contract, tax and licensing records for 7 years after the end of the business relationship, or longer if the law requires it. Server logs are kept for up to 90 days. Analytics data is kept for 14 months.
Your rights
You have the right to be told how we use your data, and to ask for access, correction, deletion, restriction, or a copy in a portable format. You can also object to our use of your data, and withdraw consent at any time. To use these rights, email ceo@stuttguardlimited.com. We will reply within 30 days.
If you are not satisfied, you can complain to the Office of the Data Protection Commissioner, Kenya (odpc.go.ke), or to the data protection authority in your country.
Security
The website is served only over HTTPS with modern security headers. Company email is protected with two-step sign-in, and access to business records is limited to the staff who need it.
Changes
We may update this policy. The date at the top shows the latest version.
